Representatives for MERSCORP Holdings, the parent company of the Mortgage Electronic Registration Systems registry, are facing another lawsuit over recording fees filed by counties in Minnesota.

MERS released a statement rebutting claims made by the counties of Ramsey and Hennepin in Minnesota.

Reportedly, the counties are raising questions about land recording fees and challenging MERS role in the assignment process.

“All MERS mortgages are recorded in the county land records and all required fees are paid,” MERS said in a statement.  “Moreover, MERS worked in the past with both the Ramsey County & the Hennepin County Registrars of Titles offices on an amendment to the Minnesota Recording Act that was adopted by the Minnesota Legislature.   The amendment, frequently called “the MERS statute,” went into effect on August 1, 2004 and it clarifies MERS’ legal role.”
